FTC Updates COPPA Guidance

The Federal Trade Commission revised the Children’s Online Privacy Protection Act (COPPA) on July 1 (YA, June 15, 2013), and now the agency is updating some of its guidance to help youth marketers. This additional context is outlined in the “Frequently Asked Questions” section on the COPPA website.

These current COPPA revisions focus on the obligations of ad networks to protect children’s privacy. One of the more frequent concerns was whether an ad network is deemed to have “actual knowledge” that it has collected personal information from users of a child-directed website, and if so, what are its obligations.

According to law firm Reed Smith, the government is taking a proactive approach in updating advertiser’s COPPA concerns and is likely to continue to regularly issue updates rather than wait for scheduled revisions.
